The world of contracting is changing

Businesses wishing to find a lawyer as a solution to answer a short term need for additional human resource will no longer simply call a recruitment consultant and ask them to find a short term solution.

Changes to tax regulations will mean you have to decide whether or not a contractor is a contractor or an employee1 and that decision brings with it risk of liability for tax and national insurance if you incorrectly evaluate the contractor’s status. What is the solution if you need additional legal support?

in-house-lawyer.com provides additional experienced, remotely-based legal counsel that can work effectively with you and your internal clients, to support your regular in house lawyer when you need it; but unlike contractual hires, you’re not paying for it when you don’t need it. The way we operate, outside IR35 off-payroll tax regulations, means we can support your in house legal team, at a reasonable hourly rate (a fraction of that of a high street solicitor) to deliver a range of legal support without the need for employment status checking; and because we work remotely and to your specific instruction on a matter by matter basis you’re not paying for resource which is surplus to your immediate needs.

How Does This Work?

Avoid tax liability and get the additional resource you need, only when you need it.

Our savvy and commercially astute counsel have been working from home or in the offices of clients for several years now. Trained in major corporations and charities, we have the experience of in house legal teams which your organisation needs to support your own, at times when demands simply outstrip the number of available minds and hands, or hours, to do the work.

Whenever you identify a need, contact us using the ‘need some help?’ form. Within four hours we will call you on the contact number provided (or if it’s your preference, drop you an email) to agree a time when we’d be available to take your instructions, if it’s not convenient, for us both, there and then.

On the first occasion you need our help (see the page ‘our strengths’ to establish whether our skills fit your immediate requirements) we will send you a letter of engagement to sign. We’ll enclose an engagement agreement to cover your use of in-house-lawyer without the need to run an employment status check. We can discuss anything which might concern you before we start and of course we’ll confirm that the services will be delivered outside off-payroll tax regulations.

To avoid capture under the off payroll tax regulations, each time we work with you we’ll identify the discreet service elements or a package of services which you need us to deliver and then create an Order against which to deliver those services to meet the needs of your business whilst ensuring you that the services will not be subject to off payroll tax regulations. We can attend your offices to meet with stakeholders if you consider it necessary, but we’re equally happy to work on your instruction, or hold phone or video conferences with you, to make sure that we give you what you need.

We insure ourselves against the risk of the HMRC, for any reason, deeming the hire caught by IR35 and, that you should have paid anything up to £100,000 in tax and National Insurance on a PAYE basis. So we can if necessary, cover that liability.2
